Terms of Service
The short version
Scroll Up Pro is currently free, with every feature included. We may introduce a paid plan in future, but we will give you at least 30 days' notice and we will not take away features you already rely on.
You can uninstall at any time and everything we hold is deleted within 48 hours.
These terms govern your use of the Scroll Up Pro Shopify application. By installing or using Scroll Up Pro you agree to them. If you do not agree, do not install the app.
1. The service
Scroll Up Pro adds a scroll-to-top button and related scroll enhancements to a Shopify storefront — a scroll progress indicator, a floating action dock, and infinite scroll on collection, search and blog listing pages.
Scroll Up Pro is provided by Scroll Up Pro and is not affiliated with, endorsed by, or sponsored by Shopify Inc.
2. Eligibility and account
You must have an active Shopify store and the authority to install applications on it. You are responsible for anything done through your store's Scroll Up Pro configuration.
3. Price
Scroll Up Pro is currently offered free of charge, with no feature restrictions, no trial period, and no payment details required.
We reserve the right to introduce paid plans in future. If we do:
- we will give at least 30 days' notice in the app and by email;
- features you are already using will remain available to you on your existing terms — we will not remove functionality from a store that depends on it in order to create a paywall;
- you will never be charged without explicitly approving a charge through Shopify's own billing confirmation screen.
Any future charges would be billed by Shopify and added to your Shopify invoice. Refunds, where applicable, would be handled under Shopify's billing policies.
4. Acceptable use
You agree not to:
- reverse engineer, decompile, or attempt to extract the source of the hosted service, except where that restriction is prohibited by law;
- resell, sublicense, or redistribute Scroll Up Pro as your own product;
- use the app to deliver content that is unlawful, deceptive, or that infringes anyone's rights;
- use the custom CSS or custom SVG features to impersonate another business, inject tracking into your storefront, or mislead your shoppers;
- interfere with, overload, or attempt to gain unauthorised access to our systems, or probe them without written permission;
- circumvent any limit, quota, or access control in the service.
5. Your content and configuration
You keep ownership of everything you put into Scroll Up Pro — your settings, labels, custom SVG icons and custom CSS. You grant us a limited licence to store and process it purely in order to operate the app for you.
You are responsible for making sure anything you upload is lawful and that you have the rights to use it. Custom SVG and CSS are sanitised before storage, but that is a safety measure and not a guarantee about content you supply.
6. Our intellectual property
Scroll Up Pro, its source code, design, and documentation remain the property of Scroll Up Pro. Nothing in these terms transfers ownership to you. You are granted a non-exclusive, non-transferable, revocable licence to use the app on stores you control, for as long as these terms are in force.
7. Availability
We aim to keep Scroll Up Pro available at all times, but we do not offer a service level agreement and we do not guarantee uninterrupted operation. We may suspend the service for maintenance, and we will try to do so at low-traffic times and with notice where the work is planned.
Note that your storefront button does not depend on our servers to render. Your settings are delivered to your storefront by Shopify as part of the page, so if our service is unavailable your button continues to work — only the admin screens and analytics collection are affected.
8. Third-party dependencies
Scroll Up Pro runs on Shopify's platform and on third-party infrastructure listed in our Privacy Policy. We are not responsible for outages, changes, or decisions made by Shopify or by those providers, including changes to Shopify's APIs that affect how the app works.
9. Disclaimer of warranties
To the fullest extent permitted by law, Scroll Up Pro is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be error-free, that it will be compatible with every theme, or that it will meet your specific requirements.
10. Limitation of liability
To the fullest extent permitted by law, neither Scroll Up Pro nor its officers, employees or suppliers will be liable for any indirect, incidental, special, consequential, or punitive damages, nor for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of Scroll Up Pro — whether based in contract, tort, negligence, strict liability, or otherwise, and whether or not we were advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to these terms will not exceed the greater of (a) the total amount you paid us for Scroll Up Pro in the twelve months before the claim arose, or (b) USD 50.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
11. Indemnity
You agree to indemnify and hold harmless Scroll Up Pro against claims, damages, losses and reasonable legal costs arising from your misuse of Scroll Up Pro, your breach of these terms, or content you supply through the app.
12. Termination
You may stop using Scroll Up Pro at any time by uninstalling it from your Shopify admin. Uninstalling removes the app from your storefront immediately, and everything we hold for your store is deleted within 48 hours.
We may suspend or terminate your access if you materially breach these terms, if required by law, or if Shopify removes the app from its platform. Where circumstances allow, we will give notice first.
13. Changes to these terms
We may update these terms. Material changes will be notified in the app or by email at least 30 days before they take effect. Continuing to use Scroll Up Pro after that date means you accept the updated terms. If you do not accept them, uninstall the app.
14. Governing law
These terms are governed by the laws of Karnataka, India, and the courts of Karnataka, India have exclusive jurisdiction over any dispute, except where mandatory consumer protection law in your country of residence gives you the right to bring proceedings elsewhere.
15. General
If any provision of these terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets, on notice to you. These terms, together with the Privacy Policy, are the entire agreement between us regarding Scroll Up Pro.
